Abstract
The purpose of this study was to determine and assess the implementation of
the registration of the recognition of indigenous property rights by the heirs relation
to the legal protection for the heirs in Klaten district; and the factors which become
obstacles in the implementation of the recognition of registration of property rights
by the customary heir relation to the legal protection for the heirs in Klaten.
This study is an empirical research using field data as the data headliner. The
data analysis methods used in this research is descriptive qualitative, ie data obtained
from the study are presented descriptively and qualitatively processed with the
following steps: (a) data obtained from the study were classified according to the
research problem; (B) The results of further systematized classification; and (c) data
has been systematized and analyzed to be used as a basis for drawing conclusions.
The results of this study are: (1) The registration of land property rights of
indigenous land conversion activities include registration for the first time, then
followed by maintenance of land registration data. After looking at the applicant or
registrant of the service system of land registration in the Land Office, including
already prepared everything, then the next applicant / registrant can immediately take
the appropriate land registration system of the Land Office services are already
integrated. Land registration requirements have not been certified status of land
rights, right of way acquisition Conversion of land ownership transfer by inheritance
is based on a peace agreement. Requirements that must be met in accordance with
the above description of enrollment requirements and it is important to note the letter
C book, Death Letter, Statement of Heritage. If there is a mistake in issuing
certificates heirs that are not listed in the certificate can file a lawsuit to the court to
request a court decision or determination of the judge who has the authority over the
land; and (2) Factors to be obstacles in the implementation of the registration of
customary recognition of property rights by the heirs relation to the legal protection
for the beneficiaries in the district of Klaten is an error in the making of the
certificate by the registrar of land rights. Errors can occur if the data in the
registration rights to data inaccuracy or lie / dishonesty applicant eg certificate of
inheritance is one of the heirs is not listed as an heir in foreign countries, did not
know of its existence and so forth. Registration required transition due to inheritance
rights in giving legal protection to the beneficiary for the sake of order administration
of land registration, so that the data is stored and served always show the latest state
of the implementation of land registration ordered by BAL does not use a system of
positive publicity, the truth of the data presented is guaranteed by the state, but rather
uses a system of negative publicity. Negative publicity in the state system does not
guarantee the accuracy of data presented. But even then it is not intended for use
purely publication system.
