TANGGUNG JAWAB NOTARIS YANG TELAH WERDA DAN PERLINDUNGAN HUKUM TERHADAP WERDA NOTARIS ATAS AKTA YANG DIBUAT OLEH ATAU DIHADAPANNYA SEBELUM WERDA

Abstract

Penelitian ini mengkaji dan menganalisis bentuk pertanggungjawaban hukum notaris yang telah werda yaitu baik secara administrasi, perdata maupun pidana serta macam-macam sanksi-sanksi berupa sanksi administratif, perdata, pidana dan perlindungan hukum terhadap notaris yang telah werda sehubungan dengan akta yang dibuatnya sebelum werda.

Permasalahan penelitian ini adalah bagaimana bentuk pertanggungjawaban notaris yang telah werda terhadap akta yang dibuatnya sebelum berakhir masa jabatannya dan bagaimana perlindungan hukum terhadap werda notaris sehubungan atas akta yang dibuat sebelum werda. Penelitian ini dianalisis secara kualitatif dalam bentuk laporan hasil penelitian yang bersifat deskriptif dan pendekatan penelitian ini adalah pendekatan perundang-undangan dan pendekatan kasus dengan jenis penelitian yuridis empiris.

Dari hasil analisis penelitian ini, bentuk tanggung jawab notaris yang telah werda terhadap pelanggaran undang-undang jabatan notaris, dapat dipertanggungjawabkan baik secara administrasi, perdata dan pidana serta macam- macam sanksinya. Kemudian perlindungan hukum terhadap werda notaris sehubungan atas akta yang dibuatnya sebelum werda yaitu berupa perlindungan dari notaris itu sendiri, regulasi peraturan perundang-undangan, pasal-pasal pidana daluwarsa penuntutan dan bagian pengayoman dari Ikatan Notaris Indonesia (INI).

This study examines and analyzes the forms of responsibility of a notary who has ended his / her term of office, either administratively, civil or criminal, and legal protection against a notary who has terminated his / her term in connection with the deed he / she made before werda. The problem of this research is how the form of responsibility of the notary who has ended his / her term of office on the deed he made before the end of his / her term and how the legal protection to the notary which has ended his / her term in relation to the deed made before werda. This research was analyzed qualitatively in the form of descriptive research result report and this research approach is approach of legislation and approach of case with kind of juridical empirical research. From the analysis result of this research, the form of responsibility of notary who has ended his term of office against the violation of the law of notary, can be accounted for either administratively, civil and criminal as well as various sanctions. Then the legal protection against the notary that has ended his / her term in relation to the deed he / she made before werda ie in the form of protection from the notary itself, the regulation of the law, the expired criminal prosecution sections and the advisory part of the Indonesian Notary Association (INI).
