ANCAMAN HUKUMAN DALAM PASAL 2 UNDANG-UNDANG NOMOR 31 TAHUN 1999 TENTANG TINDAK PIDANA KORUPSI DALAM PERSPEKTIF HUKUM ISLAM

Abstract

Korupsi adalah masalah besar bangsa Indonesia yang belum bisa diatasi hingga sekarang. Praktek korupsi yang terjadi hampir dalam segala lini aspek kehidupan telah menjadikan negara Republik Indonesia sebagai salah satu negara dengan angkat korupsi tertinggi. Pada dasarnya negera Republik Indonesia adalah negara dengan mayoritas muslim terbanyak di dunia, sangat disayangkan masih banyak dijumpai kasus tindak pidana korupsi terjadidi negeri ini. Buruknya moral dan rusaknya akidah serta kesenjangan yang sangat ketara di Indonesia ini menyebabkan kasus tindak pidana korupsi selalu terjadi. Tujuan dari peneliatian ini adalah untuk mendeskripsikan tindak pidana korupsi menurut dua sistem hukum yang berbeda dan dapat membedakan antara tindak pidana korupsi menurut sistem KUHP dan hukum Islam. Jenis penelitian ini adalah penelitian pustaka (library research) dimana sumber utamanya diperoleh dari sumber-sumber tertulis seperti perundang-undangan, buku, jurnal, hasil penelitian, ensiklopedi, Al Qur’an dan hadist dengan pendekatan yuridis normatif. Hasil dari penelitian ini yaitu terdapat perbedaan pada, pertama pengertian dimana hukum positif lebih jelas memaparkan karupsi yang tertera pada undang-undang sedangkan pada hukum Islam merujuk pada beberapa istilah, kedua pada aspek jenis dimana hukum positif lebih banyak mengkategorikan jenis-jenis tindak pidana yang masuk ke dalam tindak pidana korupsi, ketiga pada sanksi dimana hukum Islam lebih tegas dan menjadikan hukuman mati dan potong tangan sebagai hukuman tertinggi sedangkan hukum positif hanya berupa hukuman kurungan dan hukuman mati (bila dalam keadaan tertentu). Corruption is a major problem in the Indonesia that has not been overcome until now. The practice of corruption that occurs in almost all aspects of life has made the Republic of Indonesia one of the countries with the highest corruption. Basically, the Republic of Indonesia is a country with the majority of Muslims in the world, it is unfortunate that there are still many cases of corruption in this country. Bad morale and destruction of creeds and gaps are very striking in Indonesia this causes corruption cases always happen.The purpose of this study is to describe the criminal acts of corruption under two different legal systems and can distinguish between criminal acts of corruption according to the Criminal Code system and Islamic law.This type of research is library research where the main source is obtained from written sources such as legislation, books, journals, research results, encyclopedias, Al Qur'an and hadith with normative juridical approach. The result of this study is that there are differences in the first, where the positive law more clearly describes the corruption that is listed in the law while in Islamic law refers to some terms, the second on the type of aspect where the positive law more categorize the types of criminal acts that enter into the criminal act of corruption, the third on sanctions where Islamic law is more assertive and makes the death penalty and hand cut as the highest penalty while the positive law is only a sentence of confinement and death penalty (if in certain circumstances).
