Implementation of the ‘Entrusted’ Status for Children in Conflict with Law Placed at Youth Social Protection and Rehabilitation Center in the Jurisdiction of Sleman
Abstract
This study examines the implementation of children in conflict with the law with
entrusted status, with a focus on children placed at the Youth Protection and
Social Rehabilitation Center (BPRSR) in the Sleman jurisdiction. This study
identifies the practice of placement child with entrusted status and the
implications of the use of the phrase “entrusted” during judicial process for
children in conflict with the law. This study uses an empirical legal research
method with a sociological approach, through interviews with relevant local
government officials and law enforcement officers. The results of the study
indicate that there is a discrepancy between applicable law and practice during
judicial procces for children in conflict with the law with the status entrusted
placed at the Youth Protection and Social Rehabilitation Center. The use of the
phrase “entrusted” in the judicial process has created injustice and legal
uncertainty that harm the children's rights. This study recommends to
strengthening the level of professionalism of law enforcement officers and
recommends that the Youth Protection and Social Rehabilitation Center in its
practice adjust to applicable law.
