The Need of Humanitarian Intervention in the Non- International Armed Conflict in Syria
Abstract
Many states in the world interpreted sovereignty solely as absolute rights to do anything in their own territory and jurisdiction. The narrow interpretation of sovereignty caused misconduct by the state towards the people in its jurisdiction. This is what happened to the people in the territory and jurisdiction of the Government of Syria from 2011. The Government unleashed a massive military operation conducting by the armed forces to quell the protestor in Syria. The protestor reacts by forming an armed group to counter-balance the government's armed forces. Conflict stepped into an armed conflict with the organizations Thousands of people killed and more than one million people displaced because the impact of the conflict between the government of Syria and the opposition groups. The government tends to do all kind of efforts to defend the absolute rights of sovereignty, even if it is violated the highest norm of civilized humanity. Surprisingly, the international community did not react as strong as in the case of Libya. There are no certain actions performed by the international community, especially from the United Nations, Exactly from the Security Council as the guardian of international peace- security.. The case of Libya and Syria is similar in the scope of international law, there are massive violations of human rights, humanitarian law and the highest norm of international law cannot tolerated the actions conducted by both dictator. The Security Council reacts quickly in Libya by imposing humanitarian intervention, in the other side the Security Council do nothing significant in Syria. The facts provide several violations of Humanitarian law, Common article 3 of Geneva Conventions, the Additional Protocol II and Jus Cogens. Based on the UN Charter, the Security Council should decide the conflict in Syria as threat to international peace and the Charter gives Security Council to take an action on it, one of the actions included intervention to save the humanity. The conflict in Syria is still ongoing without proper treatments by the International community to save the civilian lives.
