Perlindungan Hukum Konsumen Pada Warung Makan Yang Tidak Mencantumkan Harga (Studi Pada Rumah Makan Padang Kelurahan Bener)

Abstract

This study aims to analyze consumer protection at food stalls that do not list prices and the factors that cause food stall owners not to list prices. The problem formulation is (1) how do consumers protect food stalls that do not list prices? and (2) what factors cause food stall owners not to list prices? This type of research is empirical legal research. The research data needed is primary and secondary data. The data collection method is random sampling. Data was collected by means of literature study and interviews. The results of the study show that consumers are still not protected in their rights to information regarding food prices at food stalls in Padang restaurants in Bener Village. Padang restaurant business actors in Bener Village have also not implemented the provisions of Article 2 paragraph (1) of the Minister of Trade Regulation Number 35/M-DAG/PER/7/2013 and have not implemented the obligations of business actors to act in good faith according to Article 7 UUPK. Protection for consumers who have eaten or are currently eating at the Kelurhana Bener food stall and who feel they have been harmed by the actions of business actors can exercise their rights, namely suing business actors both in civil cases regarding Unlawful Actions (Article 1365 of the Civil Code in conjunction with Article 23 UUPK) and reporting crimes on the basis of Article 62 UUPK. The factors that cause food stall owners not to list prices are that it has become a habit for business actors not to include prices and because prices of basic commodities fluctuate.
