| dc.description.abstract | Penelitian ini berjudul” Tanggung Jawab Notaris Pengganti dalam hal Notaris yang diganti meninggal dunia sebelum cuti berakhir”. Notaris merupakan Pejabat Umum yang memiliki hak untuk cuti, ketika akan cuti wajib menunjuk Notaris Pengganti untuk menggantikannya namun ketika dalam waktu cuti tersebut Notaris meninggal dunia, maka menimbulkan status hukum yang berbeda bagi Notaris Pengganti, terkait tugas, tanggungjawab serta kewenangannya dalam melayani masyarakat. Dalam hal itu terjadi kekosongan hukum antara Notaris Pengganti dan Notaris yang telah meninggal dunia sebelum cuti berakhir, maka rumusan masalahnya yaitu Bagaimanakah status hukum Notaris Pengganti dalam hal Notaris yang diganti meninggal dunia sebelum cuti berakhir? dan Bagaimanakah mekanisme/tata urutan penyelesaian administrasi Protokol Notaris Pengganti dalam hal Notaris yang diganti meninggal dunia sebelum cuti berakhir? Tipe Penelitian yang digunakan adalah Normatif dan bersifat Deskriptif yang di dukung dengan data primer. Hasil Penelitian berdasarkan pasal 35 ayat 3 UUJN-P, bahwa status hukum Notaris pengganti dalam hal Notaris yang diganti meninggal dunia sebelum cuti berakhir, maka tugas jabatannya akan dijalankan oleh Notaris Pengganti sebagai Pejabat Sementara Notaris dan tidak perlu dilakukan pengangkatan kembali sebagai Notaris Pengganti sebagai Pejabat Sementara Notaris. Oleh karena itu Pejabat Sementara Notaris itu dapat melaksanakan apa yang menjadi kewenangannya dengan jangka waktu 30 hari terhitung sejak tanggal Notaris meninggal dunia dan dapat membuat akta atas namanya sendiri dan memiliki protokol Notaris. Notaris Pengganti dalam waktu 60 hari terhitung sejak notaris meninggal dunia, maka semua Protokol Notaris harus sudah disiapkan dan dibuatkan Berita Acara Penyerahan Protokol Notaris, Kemudian semua Protokol diserahkan kepada Notaris Penerima protokol, setelah diserahkan maka berita acara penyerahan tersebut ditandatangani oleh Notaris Pengganti sebagai pejabat sementara Notaris, Notaris penerima protokol dan Majelis Pengawas Daerah.
The study is entitled "Responsibility of Notary Substitute in the event that the Notary is replaced by death before the leave ends". Notary is a Public Official who has the right to leave, and when shall leave shall be obligated to appoint a Notary Replacement to replace it but when in the time of leave the Notary dies, it creates a different legal status for the Notary Substitute, related to his duty, responsibility and authority in serving the community. In the event that a legal vacuum exists between the Notary Substitute and Notary who has passed away before the leave ends, then the problem formulation is: What is the legal status of the Notary Substitute in the event that the Notary is replaced by death before the leave ends? and What is the mechanism / order of the completion of the Notary's substitute protocol administration in the event that the Notary who is replaced dies before the leave ends? Type of research used is Normative and Descriptive which supported by primary data. Based on Article 35 paragraph 3 UUJN-P, that the legal status of a notary replacement in the event of a Notary being replaced has died before the leave ends, the duty of his position shall be executed by Notary of Substitute as a Notary Official and shall not be reappointed as Notary of Substitute as Official Notary. Therefore, the Notary Officer may exercise his authority within a period of 30 days from the date on which the Notary dies and may create a deed in his or her name and have a Notary protocol. Notary of the Substitute within 60 days from the date of the notary's death, then all Notary Protocol must be prepared and made Minutes of Submission of Notary Protocol, Then all Protocol submitted to the Notary Receiver of protocol, after submitted then the submission of the report is signed by Notary Substitute / , Notary recipient of the protocol and the Regional Supervisory Board. | en_US |
