Bpom Regulation Number 26 Of 2021 Concerning Nutritional Value Information on Processed Food Labels from the Perspective of Shatibi's Maqasid
Abstract
Indonesia is projected to have nearly 29 million people with diabetes by 2045, alongside a
growing prevalence of prediabetic conditions that pose a serious threat to public health.
This study evaluates BPOM Regulation No. 26 of 2021 concerning Nutritional Information
on Processed Foods, specifically the provisions on serving size, through the framework of
al-Syāṭibī’s Maqāṣid al-Syarīʿah to assess its alignment with public welfare. The research
employs a normative juridical method, using descriptive and prescriptive analysis based on
the objectives of Islamic law (Maqāṣid al-Syarīʿah) and a review of the legal norm
hierarchy. The results indicate that this regulation aligns with public health protection by
mandating the inclusion of the Nutritional Information Table (ING) on processed food
packaging, giving consumers standardized data to choose a healthy diet and reducing the
risk of non-communicable diseases caused by overconsumption of sugar, salt, and fats.
From the perspective of al-Syāṭibī’s Maqāṣid, BPOM Regulation No. 26/2021 aligns with
the protection of life (ḥifẓ al-nafs), intellect (ḥifẓ al-ʿaql), and progeny (ḥifẓ al-nasl), and is
thus classified as part of the taḥsīniyyāh. This policy not only fulfills the objectives of
Islamic law in safeguarding health but also promotes holistic public welfare.
