KEINTENSIFAN PELAYANAN POS BANTUAN HUKUM BERDASARKAN UNDANG-UNDANG NOMOR 16 TAHUN 2011 TENTANG BANTUAN HUKUM (Studi Kasus Di Pengadilan Agama Yogyakarta Tahun 2016-2019)
Abstract
The implementation of legal aid in Religion Court Yogyakarta by the management as
the representative of Legal Aid Institute in Area of Yogyakarta changes in every year due to
the auction system (an offer for legal aid institutions that can accept the case at the lowest price
benchmark) from the government. POSBAKUM or Legal Aid Institution at the Yogyakarta
Religious Court is expected to be able to assist and oversee the implementation of legal justice
in accordance with applied legal rules, i.e. Law No.16 of 2011.
Based on the background, the problems were formulated: 1) How is the service intensity
of POSBAKUM in assisting the litigants at Religion Court Yogyakarta? 2. Has the system of
legal aid service applied by POSBAKUM been suitable with Law No. 16 of 2011? and 3.What
constraints are faced by POSBAKUM at Religion Court of Yogyakarta?
This research of this thesis is categorized as a field reserch using the qualitative method.
The research approach used the juridical-sociological approach by referring to Law No. 16 of
2011 on Legal Aid. Data were collected by observing the service system at POSBAKUM, and
some interviews with the Supervisory Judge, staff of POSBAKUM and people asking for the
legal aid at POSBAKUM. The results from the data validity test were obtained by means of
data triangulation technique.
The results of the research showed that the service system or legal aid service overall
has been in line with the provisions of Law Number 16 of 2011 on Legal Aid and somehow
intensive for the Supervisory Judge, staff and people asking for the legal aid though it was
found that there were some constraints found in the distribution of legal service regarding the
reticence of clients in telling the chronology of problems and the performance of the staff in
dealing with the inheritance case in which they still need a full-assistance of the judge. In
addition there is a need to add the service hours from the court to POSBAKUM.
