Pharmacists are pharmaceutical scholars who have graduated as pharmacists and declared the oath and pledge. Pharmacist is a health profession that has special characteristics, i.e. valued-system and autonomous system. In establishing the practical, the pharmacy services should adhere to three (3) rules, such as ethical norm, discipline norm, and the law. However, some violations of ethical norm, discipline norm, and law occur in implementing the pharmaceutical services which is called as malpractice. The forms of malpractice, the liability of the pharmacists, and the effectiveness of pharmaceutical rules were regarded to be necessary to be investigated. This research aimed to know the forms of pharmaceutical malpractice, the ppropriateness of malpractice liability, and the effectiveness of the available pharmaceutical rules for avoiding malpractice. This was a normatif and empirical research. Juridical norm approach and sociological approach were used by observing the pharmaceutical services done by pharmacists in any pharmaceutical services to see the real situation. These were used to know the application of pharmaceutical law to solve the pharmacists malpractice notion. The results of the study show that malpractice as an act that (1) breaks ethics, disciplines, and law; (2) does not obey the standards and guidance made by professional organization and government; (3) is caused by intended-failure or unintended-failure. The forms of pharmacists malpractice can be divided into three groups, i.e. ethical malpractice, discipline malpractice, and juridical malpractices (civil malpractice, criminal malpractice, and administration malpractice). The malpractice liability suits to the violation form. The available pharmaceutical rules for avoiding malpractice does not effective yet.
